  • Is it the Law?

Does anyone know if it is the law to disclose hiv status if someone is positive? I remember hearing on the news a few ppl being charged for not disclosing.

Do all the tgirls disclose their test results? Anyone know which ones do from experience?

This is a very sensitive topic, and there are no clear answers - the few existing court decisions contain a great deal of ambiguity and inconsistency. To date, the vast majority of charges involving HIV exposure have involved cases of unprotected sex; there have been no convictions in cases where protection has been used, but this has not yet been confirmed by judicial review (there have been charges, but they're usually dropped before the verdict because the prosecution doesn't want to risk setting a legal precedent).

I've written several papers about this, including an article that might be published in the upcoming issue of The Canadian Journal of Law and Society. I wouldn't call myself an expert, but I'm very well-informed about the issue, and I've researched the subject exhaustively.

Here's a thread where I posted some of the results from my research - it's way too long to repost.

For the record, I have posted my own negative results on this forum at least twice (I know that Lucy has as well, though I can't recall anyone else doing so) and I have copies of my perfectly-clean health record, going back several years. I've shown prospective clients my results on multiple occasions, and I'm always happy to do so - if the client is cautious with me, then chances are, he's been cautious with others.

How about if i ask a person their status do they then have to disclose the truth even if the sex is protected?

If there was precum on the condom when placed on just say by mistaked from hand to condom then lubed and the person penetrates can the bottom get infected?

So then i have read some reviews where some of the tgirls (i wont mention names) have given BJs and recieved BJs without condoms. In this case if the person getting the BJ without a condom had HIV i would assume they would have to disclose?? If not then they are committing a crime?

There is a case currently being talked about. She knew she was HIV positive, yet still went to bars and picked up guys. She has had unprotected sex with around 10 guys they know about, and protected with a number more. The case revolves around one guy, they used a condom, but it broke and THEN she told him she was HIV positive. I believe that she should get a serious punishment.

There has been a lot in the news the last while about guys getting into serious trouble for having unsafe sex with others, while not disclosing that they are positive. But it's a slippery thing; especially if you have no way to give the info needed about that person to the police, when it's found out they are positive down the road.
