Currently the 'profession' appears to thrive without legislative changes?
If the mutual adult lovers are making a modest living as things stand now, is there a pressing need to formally legalize the current level of acceptance? After all if revisions to the C.C.of C, here after recognize prostitution and it's satellite prohibitions to be a bonified business venture warranting only municipal by-law governance, will this not bring all the professionals out of 'shadows' of anonymity? Do the wise and practiced in the profession need or want unsolicited publicity?
This is a dangerous case but not for obvious reasons. I am not 100% up to date on the relief sought but the essential premise is that, since prostitution is not illegal, laws that put sex workers at personal risk should be struck down. There are 3 provisions in the Criminal code that surround the issue of prostitution. These provisions make life more dangerous for sex workers. The bawdy house provision makes it illegal to do incalls. It is clear to me that outcalls are much more dangerous so I agree that this should be struck down. The bawdy house provision was enacted to get rid of whorehouses but it can be interpreted to also include an escort's residence or hotel room (and it is interpreted that way and enforced in Alberta).
The communication provision prohibits communication in a public place for the purposes of obtaining prostitution. This means that an escort must be very careful about where and when she communicates with potential clients. Fa streetwalker, she must go hide in dark alleys and put herself at greater risk. As a matter of fact, anyone directing a client or driving a client, or allowing a client to enter into a place where a sex worker awaits could be charged. I agree that this too should be rewritten.
The "living off the avails" provision makes it illegal for anyone to profit from the proceeds of prostitution. This is meant to control pimping but it can make life harder for anyone in the sex worker's circle of aquaintances. I also believe that this should be rewritten.
The danger is that groups opposed to prostitution are taking advantage of the case to try to make a case for outright interdiction of prostitution. In my opinion, these nosy loudmouths should be told to shut the fuck up. They are claiming that prostitution IS illegal and that ALL women in the sex trade are in it because they are forced to do it. Sex workers like me are all slaves and we need to help them by making it an absolute legal decree that prostitution is illegal. The arguments I hear from these fanatics are spurious at best and really should be waived aside to study the merits of the case. The case has nothing to do with prostitution but rather with the safety of the sex workers and the danger that these provisions creates for the girls as they go about their business. Since prostitution is not illegal. If prostitution is not illegal, it is safe to say that it is legal.
Just my opinion

Male spreading their seed is what we were created to do and is necessary for survival. Sex in instinct. I would fully legalize it. However, a red light district would be great if the government wishes to pimp out the field legally and get their respective cut like other citzens give to them. Making sure everyone is clean and safe is ideal. Then rates hopefully can be regulated to be fair and hopefully they can weed into a good selection of people to showcase to represent the service. Outcalls would be available at a premium with security persons available for her safety. Maybe I can be the manager of this. I see lots of profit to be made.
I think that one slim possibility is the full takeover of the industry by the government. If this were to happen, then sensual lover is correct. There would be licensing and taxation and health control. There would continue to be a black market but it would be significantly reduced. I am not sure if this is very likely with a conservative government in charge. They are much more likely to sweep the issues under the rug and do nothing significant either way.
A slightly more likely outcome would be the criminalization of prostitution as has been undertaken in the USA. This would make things even harder than they currently are for the girls.
The best outcome would be that the three provisions are reworded to be more specific in order to make things safer for the girls while preventing things like pimping, streetwalking, and whorehouses.
We will know soon enough what comes out of all this.
