Transgender people in Ontario can apply for an amendment of their birth certificate to the government without having to undergo sex change surgery in advance, as required by current law on civil status.
A recent decision of the Court of Human Rights of Ontario described as "discriminatory" policy of the registrar of the province, which requires a certification that the plaintiff has indeed undergone transsexual surgery to change the "X" box in the section of gender on her birth certificate.
"(...) It perpetuates stereotypes about transgender people, and the need they have surgery to live according to their gender identity," said the Tribunal's decision.
In its 95-page decision, the Court of Human Rights in Ontario requires therefore that the Ontario government continues to claim that transsexuals have surgery to change their birth certificates.
The Tribunal also gives the government six months to rewrite its criteria.
The decision of the Court of Human Rights in Ontario focuses on the cause of a person identified by the letters "XY", which, in 2008, underwent removal of the testicles to get him medical evidence for changing his birth certificate from male to female.
The appellant stated that the requirement of the provincial government violated his right to equal treatment without discrimination based on sex or disability.
