Crag you don't seem to understand. If you kill someone that "happens" to be gay you did not target this group. It just happened. When you charge someone with a hate crime, it is because the motive was discrimination. Not all murders are hate based as you claim. Greed, Passion, and jealousy are just 3 other reasons to kill someone. When you target a certain group and commit crimes against that group, that is hate. What the Nazi's did to the Jews was exactly this. The upraising of the Nazi party in Germany and it's roots, has make sure we learnt from our mistakes. Hence why there is modifications to the Free Speech to eliminate Hate and Discrimination from the Constitution. If Hate rants are illegal, then you must understand that crimes must also must be much more severe.
Graffiti is illegal. Tagging your name on the side of a synagogue will get you charge with mischief (Fine: 5000$ or more). BUT you tag "Fuck the Jews" on the same synagogue and they will charge you with Mischief and Hate (10 Years).
When you commit crimes against minorities, expect them to use the Law to protect themselves. It's our way to say, Stay away from us. In our society, we have these rights: Free will, Libert, Civil liberties, Political freedom, Freedom of assembly, Freedom of association, Freedom of choice, Freedom of speech, Economic freedom, Moral responsibility, Academic freedom, Intellectual freedom, Scientific freedom, Self-determination (philosophy) and Autonomy. Discrimination conflicts with most of these.
