Will Kaitlynn Jenner go to Boy or Girl Jail

This article is fairly amusing.
It asks the question of what Jail Kaitlynn Jenner may go to if convicted of vehicular manslaughter charges.

As we all know, gender is a social construct. It has nothing to do with millions of years of evolution. It has nothing to do with millennia of social mores. It’s a personal decision. If you were born with boy parts but you decide you’re actually a girl, presto, you’re a girl. If you’re a boy who just happens to have girl parts, same deal. Nobody can tell you who you really are.
And anybody who disagrees with any of the above is something called a transphobe.
Which means this one could get a little bit tricky. Kaitlan Collins reports:

Caitlyn Jenner might face a manslaughter charge because of a February car wreck he was involved in that left one woman dead…

Detective Richard Curry said there’s “nothing really egregious” about the case, so Jenner is looking at a 50/50 chance of being charged.

So it’s a coin toss. What happens if Jenner is charged, convicted, and sentenced to prison? Will he go to a men’s prison or a women’s prison?
If you say it should be a men’s prison, isn’t that transphobic? If Vanity Fair and E! and everybody else say he’s a woman, why should the prison system say any different?
If you say it should be a women’s prison, what sort of precedent will that set? What’s to keep subsequent male convicts from declaring themselves female as well and demanding to go to girl jail?
I dunno, it’s a tough one. Maybe we should start building trans-only prisons. Otherwise, the potential for misgendering and deadnaming and other such microaggressions is too great. Criminals have feelings, too.

Don't all Trans women who have not had SRS go to the male prisons and they either house them in solitary or in special areas for other trans? I don't think Miss Jenner would be sent to a female prison. The prison system still looks upon your genitals as to where to put you.

If I am way off on this, I would love to know. It is an interesting topic these days.

I would highly doubt Jenner would face prison. It seems to be a speeding issue (in relation to the weather conditions, not the actual speed limit), and a lack of caution when driving. No impairment. So, a prison term would seem out of line when drunk drivers who kill someone often only get a couple of years.

Let's just hope she goes to jail in the first place...because she should!

Penis means male population in jail. Either way she and all TS's in prison require a certain amount of special protection.

Who remembers the mass murderer in the the US who went in as a man, started treatment while in prison, (government supplied!) grew breasts but stayed in the male population and said "prison is a great big party. All the sex and booze I want, I never want to leave."

The civilian population were rightly outraged as prison is supposed to be punishment.

We'll see what changes will become.

Just look at past legal precedents. She has a penis, she will face trial in the state of California and she will face male prison. There is no trans prisons, and the only sympathy she will face is the fact that she has no piors. Most likely probation will be her sentence.

If you doubt this, goggle Sylvia Boots and the 45 years in prison she is currently serving.

She decided to keep her penis and therefore should face the law EXACTLY like every pre-op trans-woman before her....they went to male prison. Maybe now she will understand some of the real hardships and has something to talk about on her new TV Show that will last longer that 2 episodes.

not a chance. US justice system determine where you go on your genitals, not your identity. I would be shocked if she went to a female prison. Honestly, I doubt this will even end in jail. There was no impairment and she is not a risk to society, and can afford very good lawyers, so I really don't see jail time here.

You are right....she will not see jail for this. She can afford good lawyers for the criminal charges. She is still being sued by two different parties due to her part in this incident so hopefully she has REALLY deep pockets

Where in the US? When did this happen? The US Justice system does not recognize pre Op transwomen as female. So in the eyes of Justice...she is a he and facing male prison if she was convicted.

She goes to male prison and I would file a civil rights violation suit against the U.S. justice system, as Jenner would have been given unfair treatment or even preferred treatment based on her celebrity status. There are many trans-women that are serving sentences in male prison. Is it fair to them that Jenner gets special treatment?

I doubt Jenner has got her legal stuff done yet, that takes a while .... but I digress....

if a trans woman has become legally female, the US Correctional system doesn't care while you still have your penis... Penis = MAN JAIL......

They still have a ways to go..... incarceration is managed by a lot of people of CHristian faith in the USA (Christians love their incarceration)...... they will resist putting Trans women with penises in female prisons until someone takes it to the Supreme Court I would think.

You generally have to legislate or win in court to get an American Christian group to back down on their "moral values" (whether that be slavery, gay rights, or trans rights, prisions, etc); they won't change after 2000 years without a fight.
