Any intimate act whether it is someone you just met, a service provided by an SP, BF/GF/FB, husband or wife, it is done with consent from start to finish. Otherwise, it is sexual assault and as mentioned by Craig, potentially attempted murder when "Stealthing" (removing or tampering with a condom).
