Proposed prostitution legisation
I have had a chance to review the proposed/tabled legislation. I believe it may not survive a SCC challenge, but the devil will be in the details. It would also be up to years before there could be a challenge ruling, so for better or worse it's coming.
Clearly the target of enforcement will shift from the SP to the client (Nordic model) but also to the context of the messaging and even the location between the participants. Accordingly there should be a behavioural and process shift in how business is conducted to avoid blatant contravention...and a shit load of attention.
Based on what I have seen so far I firmly believe there is a way to adjust business processes so there is minimal impact and risk comparative to the current state, but, there could be a very sudden and aggressive shift in terms of enforcement.
The messaging portion of the legislation is easy to deal with but my first question would be, how are SPs and clients coping in Sweden? That is the place to start.
I am returning to Canada soon and will look at the specifics, but I would be interested to know everyones thoughts since changes will need to be thought through, understood, and communicated out before the legislation is passed and becomes law.
