Big website owners should beware. The reason this happened is the Stop Enabling Sex Traffickers Act. This changed the way websites do business, as all websites are responsible for all content including user content on their websites. Foreign website owners are safe unless they enter the US in which they can be prosecuted. These laws were not only passed to shift liability to the website, but also to prevent the next ?Backpage? as Backpage replaced Craigslist.

The protections to website owners over their users content has been removed by this law.
It does not specifically apply to other countries however the USA has long tentacles and can seem to push their legal power across borders as they see fit.
The US government controls domain extensions such as .com
So in fact they could take over any domain name they control if they see fit and get the proper warrants or whatever.

In Canada there was the Omnibus bill passed by the PCs with Harper that includes changes to advertising rules and such.
The bill was not accepted by the opposition and I suspect the current government is looking to change it.
Advertising for escorts is legal, just being a client is not.

I have not a problem giving out information of advertisers to law enforcement as I am required to.
The fact is most on my site do not have real personal information.
However they all are available to contact so not sure why they would need my help anyone.
The ads on Shemale Canada are mostly moderated and all independant escorts, not agencys or traffickers.
In Canada i think authorities would rather use the sites to track what is going on rather than have them deleted.

Backpage did not moderate much and there was private messaging and stuff going on that was underground.

Yes they are...but unlike The US, we have better things to waste resources on. If the FBI and the RCMP get together maybe there is an issue but unless drugs or human trafficking is the reason they won?t waste resources on a sting or bust. Then our canadian law creates a huge issue. By Canadian Law, the client is the criminal. Could you imagine what could happen if a high end escort reveals her client list? How many politicians get pulled into a scandal?

Also, via this logic....the website is at fault, the client is at fault but the girl is not? What? This is the best our last government came up with...a completely illogical law.

Better idea, strike down the laws and collect your tax money...

No one was ever sure how websites fit in.
If advertising is legal then seeing escorts should be legal.

Well ******* is ok.. they currently don't charge for TG ads.. But they keep charging GG's more and more without really providing anything new or better..

People being disappointed with their service is entirely different than "Ripping people off"
To my knowledge she has not blackmailed or robbed anyone.
As there is plenty of reviews it is not a secret what her service may be like.

In general we try to only allow one profile per person and do our best to confirm they are real people.
Anyone who is reported blackmailing or stealing or exposing clients anything like this will generally be deleted immediately.
Deleting profiles on SMC based on reviews and comments here doesn't really work and many bad providers turn into good ones and vice versa. Plus what about reviews elsewhere who is monitoring those.
As long as they don't break SMC rules they can stay.

Through this mess, I called my lawyer. Here is the answer.

The Law is VERY specific about how websites fit it. The conservative government is to blame for the confusion. Presently the only thing legal in canada is escorting, but you cannot advertise, the client is criminalized, websites are liable...as per the confusing law the conservatives passed. Also, any girl working in canada without A Work visa and without Canadian citizenship risks being grouped under human trafficking and deportation.

This is taken directly from Bill C-36.

The advertising offence targets persons who place advertisements in print media or post advertisements on websites. Publishers or website administrators could be held criminally liable as parties if they know of the existence of the advertisement and that the advertisement is in fact for the sale of sexual services. Bill C-36 also allows the court to order the seizure of materials containing advertisements for the sale of sexual services, as well as their removal from the Internet, regardless of who posted them, which is also consistent with Bill C-36’s objective of reducing demand for prostitution.

Our personal escort websites, Shemale Canada, and pretty much any escort based site is now at risk.

A website is responsible for its content according to Bill C-36 Section II.B under Advertising Offence. The Liberal government proposed to modify C-36 but that is a compaign promise that died and was never even brought up for debate.

The US copied our law regarding website and advertising, and as such now can work TOGETHER. Lastly, these laws in Canada are meant to target street workers, minors, sex traffickers, victims of sex traffickers, illegal immigrants working in Canada without the proper paperwork etc. Not someone that is running a business, pays taxes, stay at home woman that does this from the privacy of their homes.
