There's another part

There is another section exempting those advertising for their "own" sexual services. So the trick was made by incriminating those who place advertisement for sexual services in their papers, websites, etc. But these laws are applicable to websites operating from within Canada. As Tiana said, when a website is operating from outside, I doubt the local government can enforce its own laws easily. For websites operating in Canada currently, most are restricting the content and style, more like time for money type of advertisement.

Can you give us the section number or quote it here? I've read the bill forwards and back for 9 months.. That is the only section in the bill I'm aware of that mentions advertising..

I agree that there's little Canadian Government can do about websites hosted in other countries.. They can block them but that is not likely to happen in Canada.. Stuff like that happens in Russia, Turkey, Thailand, China etc.. As much as Harpo's CPC wants to see us either in church or jail.. it's not going to happen..

Interesting stuff on self advertising from the Canadian Bar Association

I just came across this October 2014 paper by the Canadian Bar Association and find it contains some good points including this one quoted below which deals with the matter being discussed by Alexis and Jane. See Section E. Advertising Offence (pages 16 - 17) where the CBA points out that while Section 285.1 makes advertising for one's self permissible, then further on, Section 286.4 makes it next to impossible!

My honest opinion is that this Bill won't change things much except for the rates which will go up as in Sweden and Norway and it is the reason why men are so furious about it. Don't get me wrong, but look at the US, prostitution is illegal for the buyers and sellers, yet it is a rampant market and the rates are higher.

You are of course entitled to follow what satisfies your faculties, but what I am saying is valid and is being done now in all the major online advertising venues in Canada e.g. Escorts Canada, CERB, TERB etc.

It is also what is being done in Sweden where this law was copied from.

There is no way to get around this because it is an element in criminal convection that one has the intent (I.e. State of mind) to advertise for others their sexual services. This is impossible when the girls state in their ads it is time for money.

286.4 Everyone who knowingly advertises an offer to provide sexual services for consideration is guilty of

(a) an indictable offence and liable to imprisonment for a term of not more than five years; or

(b) an offence punishable on summary conviction and liable to imprisonment for a term of not more than 18 months.

286.5 (1) No person shall be prosecuted for

(a) an offence under section 286.2 if the benefit is derived from the provision of their own sexual services; or

(b) an offence under section 286.4 in relation to the advertisement of their own sexual services.


(2) No person shall be prosecuted for aiding, abetting, conspiring or attempting to commit an offence under any of sections 286.1 to 286.4 or being an accessory after the fact or counselling a person to be a party to such an offence, if the offence relates to the offering or provision of their own sexual services.
